Can a rheumatologist be sued for mis-diagnosing fibromyalgia for Lyme Disease over a period of ten years?

She said the patient had Fibromyalgia not Lyme Disease and the disease has progressed to ADHD, memory and cognition problems, cervical vertebral damage with neurological deficits in the upper extremities, arthritis in several joints, frequent migraines and vertigo The patient was tested at another facility and was positive for Lyme Disease and she appeared to have had it for years.

of course you can sue anybody for anything, BUT
1st: missing Lyme disease is more serious than missing fibromyalgia
fibromyalgia is not recognized as a disease entity by many Drs and many schools.. it is a disease of exclusion .. there are no tests fro fibromyalgia.. (that is not my opinion)
so for missing fibromyalgia there is no case to stand
now missing Lyme disease is different.. but all diseases that diagnoses are bases on Antibodies in blood (like Lyme ) have a lot of false positive and false negative results.. so a large debate when interpreting the final diagnosis.. that means expert Will argue about the diagnosis of Lyme disease
and finally as a rule of thumb, in order to sue , there must be damages that resulted from the misdiagnoses.. so in that cases, if Lyme disease caused only joint pain, (the patient was already treated with antiinflamatory and pain killer for "fibromyalgia) but if the Lyme progressed to neurological damages that could be prevented with antibiotics (early in the diagnosis .. than may be there is a case

NO INDIVIDUALLY! we've been discussing this extensively on lymenet and the possibility of filing a CLASS ACTION LAWSUIT!

that MIGHT work, and we've been looking for lyme literate lawyers to take this case on! know of any, join us at lymenet in ACTIVISM post about this subject!

we have law student who is privy to many cases; no case has ever been won like this that she is aware of!
