Can i sue someone for giving me hpv? |
im 17 and hes 29 right now and i would like to wait until im 18 so he doesnt get in trouble. he is the second person ive had sex with and the other person we wore a condom and we both were virgins so i am for sure its him. he gave me the cancerous hpv. i had to get a leep and it has already came back but they are watching it again. hes caused me a lot of pain and i would like to sue him for the medical costs and for emotional purposes. i also ohio in live. he also told me he has slept with over 50 women and does not use condoms because they dont work for him. he is 29 yrs. old. in most states, that is statuatory rape. Go after him since it is illegal. The only way you could sue him is if you can prove that he KNEW he had HPV before you slept with him AND that he intentionally did not tell you he had HPV. In the US, you can sue anyone, for anything, the question is, can you prove damages. If you can, it is likely you will be able to find a lawyer to take your case. If not, you won't. Some basic points will be, how do you know that the first guy was a virgin? Are you taking his word? Why did YOU allow him to have unprotected sex with you? Isn't that your resposibility as much as his? So unless he held you down and forced you, you won't have much of a case. well first off, you can go after his for statutory RAPE!... you are a MINOR!... you are willing to have sex with 29 year old guys? i'm sorry, but that is SICK!... This is a major issue. He is also a child predator if he is having sex with a 17 year old... in other words, he's sick in the head!... STOP talking to this creep before something worse than catching HPV happens to you. You want to sue him but you don't want him to get in trouble? Do you know what you're saying? You could sue him if he knew for a fact that he had hpv. And intentionally didn't use a condom with you. But if you prove all of that in court the state will jump in and charge him with attempted murder, if he is found to intentionally doing this to you. If I were you I would just talk to him and tell him whats going on. Let him know his options. Hopefully he is a reasonable person and will understand otherwise he has a chance to be locked up for awhile. If he had no signs or symptoms of the cancerous HPV that he gave you(most men don't show symptoms or are effected by it, that's why they don't test for it in men), and you consentioually had intercourse with him without a condom, then NO you cannot sue him. Maybe you should educate yourself on sex and it's consequences before doing that adult action anymore. Almost every adult in their lifetime with experience HPV, or are carriers of HPV. There are over 100 different strands of it, and the strands that can cause cancer in women rarely have symptoms for men. Get over it, stop doing the wild thing without protection or just stop it period, and take it as a lesson learned. If I was your judge, I'd laugh in your face You can not sue him because you will not be able to prove he knew he had HPV. Men can not be tested for HPV so therefor he would never have known he had it. But instead of blaming him, take some of the blame yourself. You slept with him without protection and before knowing any of his sexual history. You can not blame him when both of you were irresponsible. Grow up and take responsibility for something you could have prevented! If he didn't want to wear a condom you should have told him, no condom no sex. |
