Can you be denied health insurance that is offered as a benefit of your employment? |
If you have a pre-existing condition which would cause an insurance company to deny you coverage if you were buying it yourself, can they deny you if you are enrolling through your employer? No, you can not be denied coverage for employer sponsored health benefit plans, as long as you meet all of the definitions of an eligible employee. Federal law prohibits that. See link below. However, pre-existing conditions may have a waiting period if you don't have prior coverage. In Colorado the maximum exclusion period is 6 months. This depends on how the insurance policy was written for the group. My suggestion to you is contact your HR representative and present this question to he/she. What I commonly see is a LONG pre-existing condition period on group policies. I've seen them as short as three months, and as long as a year.
