Can my company terminate my health insurance the during my last two weeks of work after I turn in my notice?


I work for a small company in California and my manager is not happy with me no matter what I do. I plan to turn in my two weeks notice, but I have a doctor's appt next week that I cannot miss.

Will my employer cover for me until my last day or will they terminate my insurance the minute I turn my notice in? Is it legal for my employer to terminate my insurance the minute I turn in my two weeks notice in California?

Please advise. Thank you!

Typically health insurance through the company is covered until the end of the month that you stop working. It doesn't matter when you give notice. If your last day is the 1st day of the month, you are covered until the end of the month. if your last day is the 31st, that's the last day you are covered. A few companies stop benefits the last day you work. It has to be written down. When you give notice ask for confirmation of the policy.

If there is more than 20 people at your company, you are covered under federal COBRA law. If less than 20 people in the state of CA you are covered under California COBRA. The big difference is who is eligible and how long COBRA is in place.

Once the end of the month happens, you will not have medical insurance unless you take out a new insurance policy or elect and pay for COBRA.

You have 60 days to arrange for COBRA payments in which you pay your insurance premiums on the plan offered by your employer to its employees.

So, yes, they can and will definately inform the insurance company that you are no longer covered effective the last date of your employment, but they can not terminate your coverage while you are employed if they still have a plan. Your employer is required by law to give you the option to pay for your portion of the insurance through COBRA. The official notification will arrive in the mail and you have 60 days to decide if you want to do be insured this way.

It depends on the law of the State you are in. As I don't know EVERY state law, I would assume that this would not be legal as they would have to let you keep coverage until your last day of employment and even then you could be eligible for COBRA coverage, although expensive they may still have to offer it...

I think after you are terminated from the company or if you stay until your two weeks are up, the last day you are there you are covered at least 30 days past that. You have at least a month and then you will be offered Cobra through your insurance company or the option to cancel.
