If some one has Hepatitis C and is aware and does not tell his partner about it? Is it a crime?


Well Sometime happened to my friend his boy friend had sex with him and then later after a couple of times of doing in he tells him that I forgot to tell you that I have Hep C !!!!!!! I mean Really HOW COULD SOMEONE FORGET THAT ! ITS REALLY STUPID! MY FRIEND IS JUST SCARED. And I wanted to know can U get it from anal if it was gentle and there was a lot of lube, ??? And I think its breaking the Law if you know you have it and dont tell your partner and get them infected. And what actions can he take against the person who did that I think he did it so that my friend would go throught what he is going trought but that could really messe up a person's life, Please help me out with this one My friend and I are really scared, and He says he still loves him but I dont think love would have made him do that and joking around the guy told my friend that dont take it so seriously U just have to take care of your self so I am telling my friend to press charges because he is teasing him, saying It would be like romeo & juliet if he dies, That my friend should kill himself too and If my friend dies that he would not kill himself but find another man What kind of sick person is he!!!! Please offer me some legal advice If my friend doesnt want to do it I will press charges... I am more worried than he is he is blinded by his boy friend..............THANX FOR THE ANSWERS I JUST WANT TO KNOW IF ITS A CRIME ......THANX

Yes, someone can sue due to INTENTIONAL STD transmission. It would need to be proven that they knew and your friend didn't. Also, if that happened, be prepared for it to be public record and for the general public to know.

YES it is a crime..because if that person could eventually be the cause of someone elses death just for 15 minutes of fun or however long...then not only are they selfish they are killing someones heart, and confidence, and eventually soul. take responsibility and do the right things.

While I can't comment for sure about Hep C, I can tell you that in Canada it is an offense to not reveal HIV+ status to your sexual partner/s.

Best thing to do would be to contact the Epidemiology department of your local health department and ask them. Hep C is a pretty serious disease and they dont take it real lightly, but as to it being illegal, I dont know.

I believe it is illegal in all states to knowingly transmit an STD, and if the infection results in death, then the person can be charged with murder. That is the law in Illinois, at least.

Hep C is a blood borne virus. It is only VERY rarely transmitted by sexual contact.

Hep B is the one that is most often transmitted sexually.

It is called Biological GBH and it is a punishable crime

talk to a lawyer who deals with medical cases. so long as you can prove that the guy knew that he had Hep C and just didn't disclose that prior to sexual relations; then he is knowingly endangering your friend's life. the thing with penetration, regardless of it being anal and there being a lot of lube, there can still be minor tearing within the walls. it's tears, scratches, gashes, etc that allow diseases and viruses into a person's body.
make sure your friend gets tested for everything, and contact a lawyer, if only for a consultation as to what to do.

no you can not press charges because it is up to your freind to be protected. and yes he probably has it now, its very easy to catch.

maybe you can find some sleazy lawyer to pick it up and try to sue to press charges but i don't think it would hold, but you might scare the kid a lot so he doesn't do it again.
