Can an employer decide not to hire you if they discover you have Hepatitis B? |
I have hepatitis B. At the moment I am going to go on an executive physical for a pre-employment exam. Do companies have a right to descriminate and withdraw thier offer of employment if they discover that you are Hep B Antigen positive. In the past, I have seen a doctor (internalist) and they gave me a green light to work without any restrictions. Mind you he suggested not to drink a single drop of alcohol. I am applying to be a technical specialist for an oil company. Can anyone advise me in this matter? I believe the only professions that can choose to not hire you for a position because of an infectious disease antigen you have are health care positions and food/beverage industries, for obvious reasons. Having Hep B could keep you from getting health insurance through the company because of the pre-exisiting condition, but it won't effect your work at all unless you become ill. If your Doc has given you the green light to work, the company should have no problems. i doubt it if it wont affect your work, just like they cant legally discriminate against somebody who is handicapped I don't know, I would say no in most areas, but with some jobs they may fight you if you would have contact say in the medical field where you could contaminate someone else, even though it isn't likely to happen. I have helped people find jobs before, and that is really the only reason they can that I know of. No job has ever been able to turn someone away for that reason, in my experience. That was different jobs though, I don't know how much the law protects, it seems like it should though. Best of luck, it shouldn't matter. everyone tries to be careful, however, accidents do happen. if I found out you are infected, then NO I would'nt hire you. I also have to protect my employees and customers. can't really afford the insurence as it is. oil companies have lots of accidents with cuts. i dont see the point if they did however you may fire suit for bias i think it has happened before and has ended up in a lawsuit and the plaintiff winning ask if its ok to drink oil. |
