Can I Sue For A Hysterectomy?


I'm a 19 year old who just gave birth to her 1st child when I was 7 weeks I was hospitalized for bleeding behind the placenta I was seeing a clinic and using a midwife who I informed of the problem I had a 3-d ultrasound by another doctor who said based on the babies size he recommended a c-section from the start I went 10 days over due even tho I begged my midwife to induce I finally went into labor and after 30 hours 15 of them spent at 8 centimeters a c-section was ordered and my beautiful 9 pound 5 ounce son was born and I quickly lost conciseness I awoke 12 hours later and was told a hysterectomy was done and the doctor said it was only the 3rd time in 15 years he'd had a situation like that i have now been told that my clinic was not supposed to handle a high-risk case as mine was I should not have went past my due date and should have had a scheduled c-section and absolutely not labored so long Does anyone think (like I do) that something isn't right here or that I could possibly have a case?

YES!! He took an important part out of your body! It was NOT his right or decision. Sue him of all he's got and get him in jail!

It is possible to sue the clinic for giving you obviously bad care. You would want a few other doctors to review your case first to see what their opinion is on the practices that the clinic preformed for you. If the clinic handled a case outside of their areas of capabilities they most likely caused problems that could have been taken care of by the right medical staff. If you can get a few opinions from doctors that agree I would then ask a lawyer who specializes in Medical malpractice to give you a consultation.

If they gave you a hysterectomy to save your life I doubt you'd have a case. The doctor did what he thought was in the best interest of his patient and now your son can grow up with his mother. You have a beautiful child. Count your blessings that you had one before this happened to you, even though it's terrible. But you can't sue someone for saving your life.

Possibly. Talk to a lawyer though, you usually get the 1st 1/2 hr free consultation with a lawyer who can then tell u if its worth pursuing. Speaking from personal experience, beginning a lawsuit is a long, labourious, emotionally and physically draining process. You want to make sure you would have a strong case and a lot of support systems in place before you proceed. You will want to make sure that the pro's will outweigh the cons for starting a lawsuit, as they can go on for years, and make your life very difficult. Goodluck!

i am so sorry for your grief. i would imagine it was a life or death situation. you wouldn't be able to pay any doctor to voluntarily do a hysterectomy on a 19 year old. they just don't do that unless it's life threatening.
as far as suing, if you feel you must, talk to an attorney. it won't restore your physical body but IF and that's IF, there was unethical behavior from your dr/midwife than at least there will be legal reprimands.
I would also recommend seeking some counsel as far as a therapist, a minister or someone to talk to. This is big....a child and a hysterectomy. There are a lot of hormones in effect. Take time to talk to someone to help think this through.

this kind of thing does happen and the only reason they gave you a hysterectomy was probably to save your life. and yes, you can die from the complications you described
in the last few years, more young women have died in childbirth. i was told this by my doctor while i was pregnant this year. its messed up.
but im not a doctor. you should look up in the yellow pages for a malpractise lawyer, most people here might just say you hae a great case and what do they know?
its best to go directly to someone who deals with this.
