Can a Doctor be held responsible for a misdiagnosis?from carpal tunnel to DDD/rheumatoid arthritisand/or lupus |
I have a concern and maybe some of you can help me. I have been in chronic pain and out of work for months now. It started in January when I went to see my regular Doctor who felt I had carpal tunnel. She referred me to an orthopedic who agreed so then referred me to a Neurologist. This Neurologist said it wasn't carpal tunnel. He ordered some MRI's to rule out MS. Then before even looking or discussing the MRI's with me...he diagnosed me with thoracic outlet syndrome and started doing nerve blocks and trigger point injections. He said this was all work related so I filed workmans comp and got an attorney. WEll...nothing he did helped...actually I am much worse than I was in January. I'm really scared. I pulled my MRI report that shows some problems in my cervical spine. 2 Herniated discs, straightening of the lordosis and spondylosis (degenerative disc disease). THis was never brought to my attention! Now what do I do? Did he screw up and make things worse? what a mess I would say that you would have a very hard case to prove that the neuro caused you to be in more pain, especially considering that the MRI report shows the problems you had in your neck before the doc did anything to you. More than likely, the neuro did not cause you to have more pain but also did not do anything to help your pain from getting worse. As long as the treatment the neuro gave you was within the scope of practice and an accepted treatment for your symptoms I don't think the doc committed negligence. He did the nerve blocks and trigger point injections to try to help your disc disease and this is pretty much standard treatment for this. Just because it didn't help and you degenerative condition is worse doesn't mean scewed up. When you have something that is degenerative that means it is permanent and will get worse as in degeneration. no doctor is perfect, and many of them make misdiagnoses, if you didn't get a second opinion, it's as much your fault as any doctor's because you did not exercise due diligence in verifying the diagnosis before you accepted treatment. People need to take more responsibility for the care they accept and recieve. RN no the doctor is not super. he is to rely on the pathological tests which sometimes does not depict the clear picture. Diagnosis is not an exact science. Unless you suffered some direct harm, I doubt you can sue. However, that judgement call is between you and your attorney, not a bunch of non-lawyers on yahoo answers. |
