Some states are allowing employers to fire ppl that smoke, even though smoking is legal. What's next... fired if you are fat, have heart disease, are diabetic, have one leg, can't hear, etc...

Your proposal is the silliest thing that I ever heard. There isn't enough bed space in prisons or jails to house the people that deserve to be there for a lot more serious crimes than your proposed felony fat.
