Can i sue my doctor for failure to diagnose me with ovarian cancer?


I went to the E.R a few months ago with servere pain, and they told me to go to my family doctor to get checked for ovarion cysts. So when i went to my doctor she ordered a ultrasound, the day after i called to see if the results where in and the nurse told me that the doctor said i had cyst(s) on my left ovary."she was not clear on how many" She also told me that the doctor said if i was in pain just to take asprin. Now i think this is wrong considering i have a very stong family history of ovarion cancer, and the doctor basicaly ignored that fact. So i decided to get a second opinion. "I have an appointment with a very good doctor in a month" I was wanting to know if my new doctor says that i have ovarion cancer, can i sue my old doctor for failure to diagnose?

I know an ultrasound isn't going to pick up cancer, i was just shocked at the fact that the Dr wasn't going to order any test to see if it was cancerous or just a cyst"which it very well may be just that", she wouldn't do a pap because im a virgin.

I also know its called Medical Malpractice, i was trying to be more specific in saying failure to diagnose.

Also its just a thought to bring up a lawsuit.
If i did sue its not about the money its about getting the word out there that this Dr is ignoring the well being of patients.

It's called Medical Malpractice...... But, I'd wait and see what the 'very good'DR. says...... Keep in mind, in most cases the ultra sound, isn't read by the DR... it's read by a radiologist and the results transmitted to your DR..... So, the medical malpractice may not be against her.....

An ultrasound isn't going to pick up cancer....need to have a laproscopy & biopsy done. I don't know.....have your paps come back normal everytime?

yes u can sue...i mean i would...putting me through all the worry of have cancer...and dieing! Plus you can get some cash;)

I would say yes if it is causing you problems: ie: it metastasized into another region or the doctor's failure to diagnose will cause you higher medical bills, pain and suffering, death or it is harder to treat. However, if you went to get a second opinion (which you should do) and you were diagnosed with it, I wouldn't sue. That is the whole reason you get a second opinion. Suing is very difficult, takes up a lot of time and money and you should have the least amount of stress possible in a stressful time.

If you can't claim any damages it's unlikely you will get money.

You can try but how far it will go I can't garantee.

It might be just benign cysts, endometriosis or PCOS, not ovarian cancer, and perhaps you should figure out what is wrong before planning a lawsuit? Just because you have a family history of a certain cancer does not mean you have it. Cysts are very common in women, and can cause pain that you should take a pain reliever for = tylenol will be fine. I have attached a website with information on the various types of ovarian cysts.

You don't have a case besides. There was no negligence or malpractice. Why are you so fixated on suing before you even know what is going on?

Just go to a different doctor and see to your health. Your doctor sounds as if he /she is not that involved, but they might not be negligent. But see the other doctor and get this sorted.

Yes, your doctor did an ultrasound, and when they saw something that should have been of some worry they should have continued with figuring out how to solve the problem.

Well, I am an office manager and practice administrator for a family practice in the US. In medical malpractice, you have to be able to show that the dr intended harm or was severely negligent. People need to remember that they don't call it "practicing" medicine for no reason. Drs are really sleuths, trying to put together peices of a puzzle to find a solution. They generally start with the most simple explanation, treat it and if it doesn't go away, move onto another possible problem and solution.

Not to say that you shouldn't have faith in your physicians, just keep in mind that they are humans, with their own perspectives. My opinion is that more people need to take responsibility for the health issues, be persistent, know yourself, give as much good information to drs. as possible, report all sysmptoms, and remember, you know yourself and body the best! Be comfortable asking your physician questions! Don't just answer questions!
