Can a person be fired from their job while seeking help for substance abuse? |
Can a person be fired from their job while seeking help for substance abuse? No they can not. As long as the person goes to their employer and say that they need to go to rehab and go through the appropriate channels they can not be fired. I am not sure if you are in the USA or not. If you are in the USA and are out on temporary disability in order to get treatment, you should be protected. Laws vary state to state, but in general a company cannot fire you while you're disabled. I recommend you check your state disability laws. Yes you could get fired if you had to actually go somewhere, I doubt they would hold yourjob for you if you were gone for a long period of time. It depends on what type of substance abuse program you are seeking. If you just have to go every day for a short period of time or if you can have the time to go to work like outatient I don't think they can fire you just because you are seeking help. Yes and NO.......if you get into an accident at work and both of you even he hit you....have to get a drug screening and you *** up positive....yes....however.....there is a clause FMLA act that gives you liberty to take 12 weeks off of work....unpaid mind you but still off....or if you have short term disabiltiy or long term disability insurance you could go for that. Otherwise....volunterarily admit urself into the eward.....ur in for 3 days......did some classes.....and you have an excuse...just sum helpful hints...goodluck A person can be fired from their job, if found using drugs while working. If one is seeking help for substance abuse, then there should be a relatively low chance of getting fired, however, the possibility should not be ruled out. absolutely. Unless you have some kind of union protection via a union contract, then certainly you can be fired. Where I work, you can be fired as soon as they find out you even use anything. I would think so. If a person can't do their job dutys. A person should be able to take a personal leave of absance to take care of the situaltion though. Depending upon which State you live in, and how many employees the company has. Yes, it is possible. I am unsure but I would think yes if their problem hurts their job performance.
